No penalty clause for delivery delay. Review on Tata Indica V2

I am new member to this group. Dam good for automobile selection.

Just want to share my experience with all of you. It took me one year to do the survey to buy which car ? some how I finalize the Indica V2 DLE model as per my budget and other requirement after taking feedback from so many people who use this car.

I took 100% finance from bank to buy car. After negotiating with 3 dealers in Bangalore I booked the car from Prerana Motors P. Ltd. after paying Rs. 45000/- as down payment which I have arranged as personal loan. I booked the car on 13th of July, dealer promised me to deliver car on 28th July as also mentioned in the order form which is signed by me.This time frame is already more than 6-8 days as normal time for delivery.

Today 30th July still I didn't get car. When I called them dealer is saying some problem in TATA plant in PUNE and truck problem and Monson , some wrong receipt to TATA blah blah...etc..etc..but still no idea when I will get car. I spoke to there GM he commit me on phone that car will be deliver to you at any cost on WED/THU. But other salse girl is saying dealer got info from TATA that it will be loaded from PUNE on comming friday (1st AUG2003)which is also not sure. Here I am paying interest to bank for loan and no idea at all about delivery of car.

I would like all menbers here to help me out, what do to in such situation ? is there any way to cancle the booking of car from Prerana Motors Bangalore ? If I cancle what is procedure ? Will I loose the booking amount ? Can I ask them to pay penalty for the delay ?

All answer from expert will help a new person who is planning to buy any car in the market by taking loan. Please make sure about delivery on paper with some penaty cluses otherwise no idea ...
