My name is sushant naik. I am a resident of noida uttar Pradesh where I reside in a rented flat with my wife, daughter and my parents. I have been cheated by Mahagun builder and all my savings including my public provident fund savings is now gone stolen by Mahagun. Mahagun builder has duped me of a total of Rs.28 lacks. I no longer wish to live anymore and writing this as a warning to other flat buyers before they fall prey to Mahagun builder.

My case is as following:

I booked a flat in 2011 March in Project Mahagun Mascot Ghaziabad. My flat was in Avalon tower. I invested all of my savings including public provident fund as well as my father’s retirement benefit. My father was an electrician and had to quit his job in 2004 because he suffered paralysis and has been bedridden since then. My father’s life savings amounting Rs. 6 Lacks has been invested in the flat. I am the sole earner in the family. I also took a loan from HDFC for 10 lacks for which I am paying 15 thousand EMI every month. The flat was promised to be handed over in April 2014 but in June this year I was informed by Mahagun that Avalon tower building has been cancelled as it has been declared illegal by development authority. Mahagun told me that my only option was to switch to another project called Mahagun Mywoods where the flat will be ready only in 2018. Mahagun asked to shell out rs.4 lakhs more for switching to this new project. When I asked for refund Mahagun replied that there was cash crunch in the company and he has already used my money in construction and I am not entitled for any refund in such case. When I contacted HDFC and told them about this they refused to entertain my complaint. HDFC said that it was a dispute between flat buyer and builder and they are not responsible, HDFC said that if I stop paying EMI then I shall lose the rights to the flat. In total I have lost 15 Lakhs of my own funds plus Rs.3 lakhs EMI I paid HDFC over the last 3 years.

I met Mahagun company owners Dheeraj jain and Amit Jain last week. I told them about my financial condition and explained them how hard it is for me to even buy medicines for my father or Milk for my 3 year old daughter as most of my salary is spent on rent and EMI . To this Amit Jain told me that there is uncertainty in property business and they have already spent my money in buying land for another project. When I told him about my paralysed fathers life savings that has been invested in the flat Amit jain laughed at me and made a joke about approaching his good friend Akhilesh yadav for charity.

I don’t think I can withstand this cheat. I cannot explain this situation to my father and mother. I can no longer face my wife and daughter.  We were never rich but we never stole even 1 rupee from anyone all our lives. I am just not equipped to withstand such fraud. I hope my passing can bring about awareness. Please be aware of Mahagun builder. Think hard before entrusting your savings to this crook.

I had booked one flat in Mahagun, My Woods in 2010. Till June'13, I've been paying as per their demand request.

Meanwhile I shifted to Greater Noida from Noida and could not update my changed address to them due to some unavoidable reasons like leaving job and father's illness.

My father was hospitalized for months who passed away last month. 3 days back, I got a call from Mahagun that they wish to send a new year gift for which they need my changed address. I shared my address and within an hour I got one courier letter which was shocking i.e. cancellation of flat.

They never called me during this period. If it was OK till June'13, how it can be so serious in Dec.'13 when only one installment is not paid. They are exploiting us because of higher market price.

Mahagun is found to be a cheat and highly illogical real estate company. They are only concerned about making money and not about promises they make to buyers. None of its projects are delivered on time. Moreover, there customer service is worst.They work like robots who only know how to make demand letters.

The lady that deals with customers is programmed to say "CLEAR ALL YOUR DUES". She promises false dates for handing over projects.

Also, the company has made considerable changes in project plan (increasing floors in towers, building new towers thereby decreasing green area). Please be cautious while dealing with the cheaters like him and don't trust anything they say.

Get written everything in agreement. Don't Sign without reading.

Theft to the tune of 50 lacks. It is unheard of in the Indian middle class family but that is exactly what I have suffered. I am Mahesh Narayanan, a software engineer by profession and resident of Delhi. The builder company Mahagun India Pvt. Ltd. operating in NCR has cheated me to the tune of 50 lacks. I booked a flat with Mahagun in their project Mahagun Mascot located in Crossing Republik, Ghaziabad in year 2007. I have been working since the year 2003 and had been saving up for a house. I live with my retired mother who is disabled and we have been living in a rented flat since she retired in 2005. We were looking for a flat at a lower floor due to my mother’s condition and this flat located in 2nd floor looked like a viable option. I took a home loan from HDFC to part finance the flat and the remaining money was paid from my and my mother’s life savings. My mother entire retirement benefits have been invested in this flat. The purpose of buying this flat was to get a shelter over our head and not for any speculative trading.

The sales brochure given to us by the builder’s sales representative showed a prospective view of the building housing our flat. Also there was small single storied shop/commercial building indicated in front of the building.The flat was to be handed over in March 2010 as per the allotment letter agreement but the project got delayed. We were paying rent for the house we are presently living in and I was also paying pack the home loan. Then in December 2010, on a site visit, I noticed that a monstrous building was being raised in front of my flat building. This building was 3 stories in height and was spread over a large portion of land within the confines of the group housing. On enquiry I found out that this monstrous construction was in-fact the shop/commercial building. I was shell shocked! What was shown as a tiny single storied shop was being constructed as a mega shopping complex consisting of 50 shops. This meant that my flat located on the 2nd floor would now be completely eclipsed by this commercial building. I went up to my under-construction flat and could see that neither would it get any sunlight nor would it have any view. I never thought such a reputed builder would misrepresent the size of this commercial building in the sales brochure and conceal the fact that my flat is going to be completely hidden by this monster of a building. This building was being constructed just 6 meter away from the high rise tower (20 storeys tall) housing my flat. Something was terribly wrong! I contacted the builder but he refused to listen. I had no other choice but to approach the District Consumer Forum. I filed the complaint in December 2010 and got a restraining order from the forum stopping any further construction on the commercial building. To this the builder threatened that he will not handover my flat.

By March 2011 I had gone through all the building bye-laws and was sure that the commercial building was illegal in its entirety. The sanction for the illegal commercial building was given by Ghaziabad Development Authority in violation of the building bye-laws and fire safety bye-laws for the sake of bribes. The land over which the commercial building was being constructed was to be left vacant as the bye-laws. The 15 meter wide setback-open space as it is called is a necessity for fire-fighting or rescue operation on the high rise building. Due to the presence of the illegal commercial building a.k.a the shopping complex as many as 1200 residents of the flats housed in the adjacent 4 high rise towers was seriously endangered. The situtation is captured in the diagrams attached to this post. If there is a fire in either of these towers namely Milano, Ferrara, Verona and Bettina no fire fighting or rescue operation could be performed. The area needed by the fire-fighting apparatus such as a fire tender is encroached by the illegal shopping complex.

I was born and brought up in Delhi and had witnessed the UPHAAR cinema fire tragedy.  UPHAAR cinema fire was a consequence of bye-laws violations that were overlooked by the authorities such as DDA and DVB for bribe. There have been several other fire incidents in the country such as Carlton towers Bangalore 2010 that left 12 DEAD and the recent 2011 AMRI hospital fire that left 98 DEAD.

By April 2011 my flat was fully ready for handover and other allottees in the group housing started getting possession of their respective flats but after repeated the builder refused to handover my flat. Mahagun Builder appealed the restraining order of the forum in the high court of Allahabad and the State Commission but has lost . Each time I had to be present in the courts taking time off from work. I was under immense financial strain as the legal, travel expenses on top of the rent and EMI was draining every bit of my savings. Mahagun’s strategy was to tire me out so that I can succumb to his terms. There is no reason for him to with-hold my flat which has been paid for in year 2008 itself. I approached the Allahabad high court by means of writ petition seeking cancellation of sanction given to the commercial building. The High court directed me to file a petition before the State Government of Uttar Pradesh which I did.

This ordeal started taking a bad turn in August 2011 as I contracted cardiac problems due to the physical strain and was advised complete bed rest. I had to stay out of work from August till October 2011. I suffered irreparable damage to my health due to the strain and have not fully recovered yet.

In August 2011 Mahagun builder called a meeting to discuss the issues. In the meeting Mahagun directors Amit Jain and Dheeraj Jain threatened to never handover my flat. They said that till the time complaint before the consumer forum is not withdrawn the flat will not be handed over. The told me to sell off my flat and leave. I refused to give up.

State Government heard my petition in December 2011 and a decision came in Februray 2012 whereby the sanction to construct the shopping complex was cancelled. I had little hope in the State Government but they had come through. State government directed GDA to demolish the illegal shopping complex. In May 2012 the district consumer forum passed final orders and directed the builder to demolish the shopping complex building in its entirety. The forum held Mahagun guilty of Unethical Trade Practice and imposed a notional fine apart from the direction to demolish the shopping complex. The object of this post is to warn the middle income service class flat buyer and show him the real face of Mahagun India Pvt. Ltd. Behind the giant hording and the full page ad lurks the true evil, the evil that will risk the life safety of its customers to make disproportionate profits.

It has been one of the most unfortunate decisions of my life to book Flat at Mahagun Mascot – OSIMO 1317 in the name of Mohit Sharma R/O Sector 82, Noida – 201 304. Mahagun Mascot Flat was supposed to be handed over in March 2010 and has not been handed over till date.

I was categorically shown the track record of Mahagun India company for timely possession and their company motto – “We Deliver What We Commit” and I made the decision to book flat at Crossings Republic Project at higher price with respect to other builders in the region – a decision that I currently regret.

My considerable life savings have been invested and now stay – badly stuck up in their project as till date I have no commitment/written/oral Confirmation from Ms/ Mahagun India Pvt. Ltd. about when my Flat – OSIMO 1317 will be handed over to me. Builders logic that due to commonwealth games labor was not available falls flat as many projects which started later are now finished and delivered to customer around an year back - classic example Crossings builders flat. The project got delayed because the builder kept increasing the number of flats in the project due to great demand at that point of time - launching one tower after the another.

I believe they knew at the very outset that project would be delayed and we will handle that by distributing cheque. However, During the entire duration of delay and till date - I ended up paying EMI as well as Rent. And I am sure there will be many more like me.

I draw your kind attention towards the following figures:-

Mahagun Mascot People take great pride in telling that we disbursed the cheques - big deal. They already have close to 80% flats sold out which clearly means that they have close to 90% of all money already paid to them.

Do the maths - I m not sure but I guess (n believe it too) it is not coming out of their pockets for sure...

I will just share my scenario here.

Expenses Incurred by me :



  1. Bank EMI - INR 18, 500/- x 18 = INR 333, 000/-



  2. Rent Paid (since that flat’s possession has not been given to me as promised by Ms. Mahagun India Pvt. Ltd.) = INR 306, 000/-





I would again like to re-iterate that till date, after repeated follow ups, n number of emails and personal visit to their office - I have no commitment/written/oral Confirmation from Ms. Mahagun India Pvt. Ltd. about when my Flat – OSIMO 1317 will be handed over to me.

I have taken loan from Syndicate Bank and the bank is considering to increase the Interest Rate and the Flat Possession and Registry, and subsequent Mortgage to the Bank has not happened till date.

Due to Non-Possession of Flat OSIMO 1317 on time, I have incurred additional investment of INR 151, 000/- till date and if the Flat Possession does not happen till December 2011, I will continue to make additional, totally avoidable investments.

On top of it, I received a call from their side that I need to make additional payments close to INR 350, 000/- (due at the time of possession of the Flat) right away, which is justified as per the contract but totally unacceptable in the current circumstances.

All Mahagun Mascot Customer Care reps say is you pay the balance amount - possession would follow sometime soon - and we cannot say exact date.

On top of it, they claim to be ISO 9000 company but let me tell they dont even have a process to handle customer complaint.

AGM Customer Care for Mahagun Mascot says she does not know about the complaint where as I have a receiving copy for Nov 7, 2011 and she has that copy too in my file but still, since they do not have a process - the letter stayed in file and would have stayed there if I had not bothered to go to their office.

And they also have a demand letter for funds tucked in right after that. There are 20 calls made to check up on that but not a single call to reply to my complaint.

How they got that ISO certificate is anybody's guess now :)

Mahagun Mascot AGM I met today Dec 14, 2011 - very courteous lady but like a robot - only thing she is keen on is YOU PAY BALANCE MONEY and you cannot do anything about our company as your money is stuck.

She does not know the dates as that will come from construction department.

She promises that I will get a reply from concerned department - I am waiting.

As I would be traveling out of country again and I will not find much time to follow up with them and of course, they would be charging me interest for the outstanding amount....

So, its anybody's guess - sadly but to cut losses, I will have to make the payment - She is right, I guess... punishment must be served for trusting a local brand like Mahagun India Pvt. Ltd.

I will, like many others make the payment for Mahagun Mascot Flat but possibly government should have a obdusman kind of a body for real estate as well so that consumers like us should not be treated for a ride by builders like Mahagun by keeping cleverly worded contracts and sweet talks by Sales Reps.
