Application submitted to Lucknow Police Commissioner, Jan Sunwaayee Commissioner, DCP Gomtinagar against Vasundhara group and M.D Sudheer Singh and others.


It is humbly submitted that the applicant is a native of Sachchidanand, Village Hasanpur, Thana Saidpur, District Ghazipur, Uttar Pradesh and is working in a multinational company Infosys since 2007. From 2012 to 2019, has been deputed to Australia to serve various customers.


Through a newspaper got an advertisement of a real estate company named Vasundhara Group which was about their new project, Orchid Valley, Village Sekhanapur, Thana Gosaiganj, on Lucknow-Varanasi road(Sultanpur road). For detailed information about the project, the applicant called on the contact number 840080xxxx given in the advertisement and talked to one of his associates, Pooja Singh. Pooja Singh called the applicant the M.D. of Vasundhara Group. Sudhir Singh to his immediate office 4th Floor, Nikhilesh Palace, Opp. Appointed appointment at Jawahar Bhawan, Ashok Marg, Hazratganj Lucknow, on 14/07/2014. The appellant along with his wife Sweety and some other relatives had applied for the M.D. of the company. Met Sudhir Singh in his office. M.D. Sudhir Singh visited some other projects of Vasundhara Group. M.D. Sudhir Singh described the Orchid Valley Lucknow-Varanasi road project as a multi-year and mega project, which was to be developed in the next five years. Sudhir Singh also showed the proposed map of the Orchid Valley project which was spread over 952 acres and 14 sectors. Thus keeping in view the past work done by the company and ambitious plans for the future, the applicant decided to invest in the Orchid Valley, Lucknow-Varanasi road project of Vasundhara Group. The following were some of the main points of the Orchid Valley project, which are given in the attachment of the application along with the allotment letter:


• 25% of the total value of the plot as booking amount and remaining 75% will be payable in equal monthly installments over the next 60 months.


Before the transfer of the plot, within 60 months from the date of allotment, the company will complete the complete development of the entire project like roads, electricity, underground sewer drainage, greenery, development of parks etc.


• Also the company will convert agricultural land into residential land.


• If Vasundhara is not able to allot the land to the customer within the stipulated time period as per the given conditions, then Vasundhara Group will refund the entire amount to the customer along with 10% interest.


By collecting all the information in this way, the applicant shared these things with his friends and relatives also. The elder sister of the applicant Dr. Kalindi Devi, nephew Anoop Kumar, wife's elder sister Indu Kumari and friend Rupesh Kumar Singh also expressed their willingness to invest in this project.


On 16/07/2014, the applicant Sachchidanand, wife Sweety, nephew Anoop Kumar, and wife's elder sister Indu Kumari booked the following plots through the applicant by paying a cash amount of ten thousand rupees per person:




  1. Sachchidanand: 2160 Sq. Ft – Plot No. Sector 5/ G75




  2. Sweety: 2160 Sq. Ft – Plot No. Sector 5/ G74




  3. Anoop Kumar: 2160 Sq. Ft – Plot No. Sector 5/ G1




  4. Indu Kumari: 800 Sq. Feet – Plot No. Sector 5/ J200






After a few days, Rupesh Kumar Singh, friend of the applicant also booked two plots on 26/07/2014 by giving ten thousand rupees each through the applicant:

  2. Rupesh Kumar Singh - 1500 Sq. Ft - Plot No. Sector 5/ G148






After a few weeks, the elder sister of the applicant also booked a plot on 25/09/2014 by doing ten thousand NEFT through the applicant:




  1. Dr. Kalindi Devi - 2160 Sq. Ft - Plot No. Sector 5/G76




Thereafter, the applicant and other five requesters received the allotment letter by depositing the remaining amount of booking amount through the applicant itself. The details of the amounts deposited at this time are as follows:




  1. Sachchidananda:(09/09/2014): 2, 60, 000/-(NEFT)




  2. Sweety:(09/09/2014): 2, 60, 000/-(NEFT)




  3. Anoop Kumar:(28/07/2014): 2, 60, 000/-(Cheque)




  4. Indu Kumari:(12/09/2014): 80, 000/-(Cheque)






Indu Kumari:(23/09/2014): 10, 000/-(Cash)




  1. Dr. Kalindi:(02/11/2014): 2, 60, 000/-(NEFT)




  2. Rupesh Kumar Singh:(28/07/2014): 2, 60, 000/-(Cheque)




  3. Rupesh Kumar Singh:(28/07/2014): 1, 77, 500/-(Cheque)






The allotment letter of all the applicants and the details of the amount received by Vasundhara Group are attached with the allotment letter in the annexure.


From the month of September 2014 to the month of November 2017, we all the applicants have been paying the remaining 75% amount from time to time. But when the applicant inspected the proposed place where the project was to be developed in January 2018, after getting only nominal development, M.D. of Vasundhara Group. Concerned about the lack of proper progress. M.D. Sudhir Singh comforted by saying that the given deadline has not been met yet which is December 2019, so the allottees should not have any kind of worry or complaint. Till now, about 70% to 75% of the amount had been paid to Vasundhara Group on behalf of the applicant and other requesters. But after not getting proper development, the applicant applied for M.D. It was informed to Sudhir Singh that the balance amount would be paid at the time of registration of the land block.


In the year 2016-17, Vasundhara Group shifted its office to Gomti Nagar at the new address:

Sir please note that the applicant and other requesters were living in other cities or abroad from Lucknow due to job etc. from 2014 till now. In July 2019, the applicant once again came to Lucknow and inspected the project site. Till this time also out of the 14 proposed sectors of the project, some development work had taken place only in Sector one. Sector 5, where the allotment was given to the petitioners and the petitioners, the Vasundhara Group had not yet been able to acquire the land and neither had any work been done.


From July 2019 till now, the applicant has come several times to Vasundhara's M.D. Talked to Sudhir Singh but did not get any satisfactory reply. Every time 6 months from December 2019 onwards by saying M.D. Sudhir Singh kept avoiding the matter. Last meeting with Sudhir Singh took place in April 2022. During this, the applicant requested Sudhir Singh, citing the conditions, that because the Vasundhara Group could not complete the project as per the written condition, the money of all the other five allottees including the applicant should be returned. On this he asked to come and talk in 3 months. Sir, at present the applicant is working in Hyderabad and other applicants are also working in Delhi, Gurugram and other cities of the country. The applicant is losing money and time in coming to Lucknow again and again. For the last four-five months, Vasundhara's M.D. Sudhir Singh is not responding even on calls. We went to the new office of Vasundhara on 26/09/2022 and M.D. Tried to meet Sudhir Singh but it was told from his office that M.D. No and you come next week. Thus no reply is being received from any representative of Vasundhara Group. Because Vasundhara Group has not yet done any development work as per the given written conditions and the given deadline has been completed only in December 2019, also Vasundhara Group's M.D. Can't get any satisfactory answer from Sudhir Singh or any official. From which it is known that Vasundhara Group's M.D. Sudhir Singh We want to grab the deposits of all the applicants whose total sum is Rs 45, 37, 750/-.
