I booked flat in sheth avalon in May 2015 under subvention scheme with builder's commitment to complete construction and give possession by Dec 2017. Price was very high compare to market rate and I believe that as its under subvention where builder will bear the interest till Dec 2017 so interest part is loaded in price. At the time of registration, its mentioned in draft registration deed that possession will happen in 2019 for which I objected with builder, then builder offered me to shift in another building for which possession date is June 2018. I discussed with builder that agreed date was Dec 2017 and accordingly I choose subvention scheme so that possession will happen when subvention is over. Builder informed me that as per laws 6 months are added so its same that you will get possession by June 2018. Although it was not acceptable but I accepted it by relying on their words but that was my mistake. I am closely watching construction since last one year and come to know that till dec 2017 only brick work completed for nearly 25 story. As per present status, I believe that it will take at least 12 months to 18 months to complete rest of the work and give possession with OC. I discussed with Builder's representative but they are not giving proper reply. I sent lot of mails and visited their office multiple times. Sometimes they say that director will revert you, sometimes he is not in town etc. Till date they have not reverted me even following up with them so many times. As subvention is over in Dec 2017 so EMI will start from Jan 2018. I am pretty sure that possession will not happen by June 2018 and that's why builder don't have any answer. Now I need to pay EMI also and as possession is not happening then have to stay in rental flat and pay rent.

Further, they asked me to pay another installment with 12% GST. I objected that service tax was 5% and as per govt advisory builder should not escalate cost compared to pre-GST scenario. Earlier builder is not getting any input tax credit and Service tax was 5%. Now GST is 12% but builder is entitle for input tax credit so he should not charge GST more than 5% as cost has decreased.

I am looking to quit the project and asking him to give me refund full money with 9% interest which is as per agreement.

I would simply advice all home buyers to not to trust on ANY builder in current scenario and whenever they give any commitment, then pl take it in writing signed by competent managerial person. If they refused to give in writing that means they are not sure about commitment. Its better to buy ready-possession flat instead where you know what you are going to get.
