It is everyone’s dream to own a house in Bangalore. For most of us it is only a one time opportunity in entire life span. Many times we hear about cheating by builders, real estate brokers, land mafia etc and we always try to be more cautious while buying a property or land. But in spite of that we fall prey to such cheaters. Here I am going to share my own experience and I hope it will be eye opener for everyone who aspire to own their dream apartment.
I purchased an apartment from BINDU DEVELOPERS and PROMOTERS approximately seven years back. This company is headed by Mr. Jayesh Z Shah who is expert in cheating the public and swindling money from innocent people with the help of few vested interests. My apartment name is BINDU AMULYA, situated in Anjananagar, Magadi Road Bangalore. This apartment has two phases of construction(Phase 1 and Phase 2). Mine is in Phase 1. Each phase has 140 flats each, making a total of 280 flats from both the phases. First phase was completed in around 2011-12 and second phase in 2015. When we occupied the flat there were many works pending including the promised amenities, compound wall, cauvery water supply, occupancy certificate(OC), completion certificate and many more things. Whenever we asked for these, the builder said he got the project approval for total two phases and he would give all the pending things when the second phase is completed. We all residents trusted and believed him. From the beginning to till now there is no association in this apartment. The builder used to collect the maintenance fee in cash and he only used to do maintenance of the apartment. We all thought he would give us OC and finish the pending works after second phase construction is over and form an association. But later we realized that he is not a trustworthy guy and he is a biggest scamster. Please read below.
He completed second phase project by October 2015 and new owners started occupying their dream houses. Now we old residents went to him and asked for OC and promised amenities. He said he will give OC and give all promised amenities, complete pending works in 3 months. Again we believed him! 3 months over and nothing was done. Again we asked him in January 2016 and he said he would give OC by April-May 2016. Likewise he made a habit of fooling residents continuously from 7-8 years. Till now he has not given us OC, CC, Cauvery water, community hall, swimming pool and more.
Now people who are reading this review will definitely have one question in mind. Why are 200 plus apartment owners not taking any action on this defaulter builder? Please read below story and you will get the answer!
Out of 280 flats around 45 flats are still unsold. Another around 40 flats are occupied by builder’s kin and kith. These kin and kith include builder’s blood relatives, business associates etc. Example – Builder’s brother, some of his close family relatives, his civil engineer, his architect, his real estate broker, the person who does flooring for his projects, the person who supplies wood for his projects, the people who supply building materials for his projects, the people who gives financial support for him, the person who gives cable network for entire apartment, the people who give him political support for him etc. These kin and kith have got apartments at a very good deal and they are extremely loyal to Jayesh Shah. Some people even treat him as second god. They do not want to see Jayesh Shah in trouble for any reasons, no matter what happens to them or their apartments. They are hardcore supporters of him.
As I mentioned earlier, this apartment has no association. Even today Jayesh is only doing maintenance by forcefully collecting the cash from the residents. These KIN & KITHS do not want to take over maintenance until they get OC & association is formed(and also because many of these people do not pay maintenance fee). But this cheater Jayesh is not giving OC. This episode is going on since last 8-9 years and there seems no end. Few years ago I was part of maintenance fee collection team. We used to go door to door and collect the cash. During that time some of his kin & kiths used to say “Jayesh Bhai will never take maintenance fee from me. If you have doubt please call him right away and ask? “. This is the attitude of his Kin & Kiths.
After 2015, once the builder broke his promise people hesitated paying cash to builder for maintenance. Rather they insisted the builder to complete the project, give OC, form association and take over the maintenance from the builder. But these KIN & KITH always supports builder and they are no way concerned about the welfare of residents. We don’t know how much money he is spending for maintenance, how much money is pocketing. He is not accepting any cheque, DD, or bank transfer. He is taking only in CASH!(you can understand the reason). As per our information most of these kin and kith never pay maintenance fee and builder Mr. Jayesh doesn’t pay maintenance fee for around 40 unoccupied flats(He is saving around Rs. 14 Lakhs per year like this). When there is no unity among the residents we can’t take any action on this fraud builder. This year many people denied paying cash for maintenance fee and they were ready for digital payment. Such people were harassed by Goondas(some of these KIN & KITH become goondas when the situation arises to safeguard Mr. Jayesh). They have even cut the electricity connection of people, diffused their vehicle tyre pressure etc and created many other nuisances to the residents. No one has right to cut the electricity supply of a resident, it can be done by only BESCOM in case of non-payment of bill. By doing such heinous acts, they are proving their goondaism, hooliganism, arrogance and mafia. They have made BINDU AMULYA apartment a horrible place to live. It is all because they wanted to keep one fraudman Jayesh safe and secure. When your co-residents can cut off your house’s electricity supply using muscle and goonda power, what is the use of owning such a house? Is it a residents society or Taliban? It is better to stay in rented house than this kind of worst apartment which is filled with rats(I am not saying all residents are bad. There are many really good people here. It is only 25% people who are involved in mafia with builder and control everything). I have also heard that few residents were threatened for expressing their views against cash payment.
Mr. Jayesh is not giving complete income/expense data of maintenance. We don’t have answers on how much money is spent, how much is the collection, corpus fund etc. As I mentioned earlier he is not paying maintenance fee for his 40 plus unsold flats. If the payment is handled digitally we will have answers for all these questions.
There is no rules and regulations in the apartment. Some adults along with their kids play cricket in parking area damaging other’s vehicles, people throw garbage in common area, people spit in lifts and common area, some days few auto drivers park their auto inside the apartment premises etc etc. No one is able to take any action because there is no association.
If all the residents are united; this fraud builder can be sued and put behind bar. Many times we have requested these KIN & KITHs to bring Jayesh for meeting in apartment with residents. But he never came for meeting after 2016. We can understand that he trying to hide himself and roam(It is a common trait of a thief). Some residents by supporting this thief, they have also proved to be thieves and partners in looting. Few of these KIN & KITHS have invested black money and they don’t mind even if they lose this property. But they don’t want to end the business relationship with the builder.
It is a tragedy for the people who have invested their sweat to own their dream homes. This clumsy builder with his Kin & Kith is playing with innocent peoples life. Real Estate is a very cruel mafia. They don’t even care other peoples life to cook their food. So please avoid this cruel builder. We have heard that this builder has strong support from local politicians and goondas. He can do anything to your life if you go against him or question him.
So my advice to people here is please double check, please double check, please double check before buying any property. Cheaters like Jayesh are plentiful in this world. More importantly some cheaters have got the followers(to share the stolen money) like Bindu Amulya Apartment has.
