TATA Indicom had advertised on the electronic media [Televisions], that they are offering TATA Indicom to TATA Indicom unlimited free outgoing for two years if a customer opts for the two years incoming free scheme. The unlimited out going free was given only for the two years incoming free scheme & not for life time free scheme. This was for prepaid only as TATA Indicom had not entered the post paid market then.
Since I wanted unlimited outgoing free facility I bought two TATA Indicom mobiles with two years incoming free scheme in January, 2006 for 8400 INR. However all of a sudden TATA Indicom changed the scheme & stopped offering unlimited outgoing free. I had hardly used the mobile for three months & the ultimate purpose of buying two TATA Indicom mobiles with two years incoming facility had been defeated.
This is cheating & breach of consumer rights. On calling up helpline I was told that all the customers were informed by SMS that from 14th May 2006 on refilling the mobile the customer would get only 500 minutes TATA to TATA free valid for a period of one month only. I never received any such SMS on either of the two numbers which TATA Indicom cliams to have sent.
I took two years incoming free scheme to get unlimited outgoing free for two years within the network, if out going unlimited free would not have been my requirement I would have instead bought life time incoming free & that too just one mobile.
Even better I would have had my existing BPL postpaid connection converted to prepaid & then have it refilled for just 999 INR instead of buying a TATA Indicom CDMA mobile for 4200 INR.
On filing a complain with International Council of consumer rights a notice was sent to TATA Indicom. To this TATA Indicom denied offering any such facility in the first place. But I did make unlimited calls from January 2006 till I refilled my card after 14th May 2006. Can they explain how was that possible. To this wanted us to provide them with the video clipping of the said advertisement.
It is but natural that you do not save advertisements, be it print advertisements & no question of saving an electronic advertisement. Its not only me but many who have been taken for a ride by TATA Indicom.
Bottom line TATA Indicom has cheated its pre-paid subscribers giving false advertisements to capture the market. Any one who intends to fight against TATA Indicom on this case if they have had the same experience please get in touch with me. Maybe if we have a huge number of complains we can file a case once again in a different way by arguing that a huge volume of subscribers can not be liars. Better still if any one has that clipping saved please forward it to me.
Please ensure its that advertisement that was being aired during December 2005- January 2006 only as the new advertisements now have the clause in fine print with asterix's around.
