A serious issue about the project and a legal case being filed. Lalit Kumar Jain booked for cheating, breach of trust and forgery by Kothrud police Pune in project KUL 45 Nirvana Hills.


The Kothrud police booked Lalit Kumar Jain and other directors of Kumar Sinew Ltd, on Saturday evening, for cheating, breach of trust and forgery with relation to a piece of land measuring 79 hectares and 30 gunthas on Survey No 44 in Erandwane — the site for the company’s luxury housing project 45 Nirvana Hills — after being directed to do so by the judicial magistrate’s court.


The land in question was originally owned by a 350-year-old trust that governs the affairs of the Thorla Shaikh Sallah Dargah. On March 25, the court had directed that a criminal complaint be lodged against the accused after the managing trustee Kazi Sayed Ziauddin Nizamuddin (61), a resident of Syanagogue Street in Camp, filed a complaint against Kumar and others with Kothrud Police Station.


As per the FIR, the police have booked Lalit Kumar Jain, Aruna Ashok Bhat, partner at A V Bhat & Company, the company itself, Shailesh Ghisulal Hingad and Krishnan Laxminarayan of Kumar Sinew Ltd. However, none of the accused have been detained by the police yet.


They been charged under Sections 199, 200, 406, 417, 420, 471 and 474 read with Section 120 (B) of the Indian Penal Code (IPC). It is alleged that the accused hatched a conspiracy to grab the land on the basis of forged documents and transfer the ownership of the property.


In 1982, the said piece of the land was leased out to A V Bhat & Company for 50 years. However, in 2005 A V Bhat & Company along with Megapolis Developers were acquired under Kumar Sinew Ltd. It is alleged that after this, the accused first mortgaged the land to various companies and then started developing the land without permission from the trust and charity commissioner.


Nizamuddin, who is the complainant in this case, also alleged that the accused kept the trust in the dark and claimed the Transfer of Development Rights (TDR) and Floor Space Index (FSI). “Jain and the others deliberately allowed slums to develop there to benefit from slums rehabilitation scheme.


They tried to cheat the government too, ” he said. Police Inspector (Crime) S B Navale of the Kothrud Police Station, said, “As the case has came to the police from the court, we will conduct an inquiry into the matter and then submit a report to court within the given deadline of May 24, 2013.”


“The accused will be summoned within a couple of days for an inquiry. We will verify the evidence they claimed they have. There is no need to make immediate arrests. We will hear both parties before we come to any conclusion, ” Navale said. Trust's Claim


?  In 1982, Ashok Bhat, a partner of A V Bhat & Company signed a lease for the said land Bhat was to pay the trust Rs two lakh per year, but violated the agreement and made an agreement with Megapolis Developers Pvt Ltd


?  A case was registered against the company, but the matter was settled when Bhat said he would make a payment of Rs 4 cr and seek permission from the charity commission


?  Neither was done. Bhat’s company and Megapolis Developers were acquired by Lalit Kumar Jain and renamed Kumar Sinew Ltd


?  Kumar additionally took a loan of Rs 2, 115 cr on the land is developing the land illegally


?  The trust had asked that the lease be annulled and the land falling under Survey No 44 be returned to their possession
